eighmie rated 11 months ago- watch this video for a health inspector's blatant violation of an Indiana citizen's 4th amendment rights. If you tell a government agent that they cannot enter your property without a warrant in the absence of exigent circumstances, they should be educated enough in their responsibilities as an agent of the government to honor your request to vacate your property. Make no mistake, the health inspector was there to gather evidence against the individual, just as a social worker or a friendly police man investigating you. She could have moved around the property line and taken pictures from areas that she was legally allowed access, her camera clearly had a telephoto lens, if she took those picture before a judge, he might issue warrant granting her access to the area of this gentleman's "yard" that she felt required her personal inspection. Her laziness and failure to do her "due diligence" have left Indiana, the Sherrif of La Porte county, IN, and herself (personal liability) open to civil damages.

stimulantcaplets rated 12 months ago- Without knowing the facts here, it's impossible to say whether the trespass and inspection was legal or not. What can be said is that this was handled extremely unprofessionally, and that neither the officer or the "health inspector" had done the work necessary to know themselves whether they had the legal right to trespass.
Shouting "My propertyyyyyyy!" and "yer gonna make me rich!" didn't help matters either, but it's the responsibility of the civil servants implementing the law to know and follow it, and these yokels obviously didn't. Saying, "If you don't have anything to hide, you shouldn't mind if we take a look around," is simply intimidation. It's not a search warrant, and if you don't have one, and you don't know if you should have one, you need to go find out, not shrug your shoulders and do whatever you feel like. There's nothing urgent here that can't wait a day.
What's sad is that nothing will come of this. No disciplinary action or demotion.
