The John Warner Defense Authorization Act of 2007, which was quietly signed by Bush on October 17, 2006, the very same day that he signed the Military Commissions Act, allows the president to station military troops anywhere in the United States and take control of state-based National Guard units without the consent of the governor or local authorities, in order to "suppress public disorder." Some may think this is 'old news' but I'm inclined to pay attention to it.

Despite the critics here, posse comitatus has been a point of law for well over a century and preserves the freedom of the citizens of the United States from the use of the military on orders of the federal government. The Posse Comitatus Act, 18 U.S. Code, Section 1385, an original intent of which was to end the use of federal troops to police state elections in former Confederate states, proscribes the role of the Army and Air Force in executing civil laws and states: Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined not more than $10,000 or imprisoned not more than two years, or both. According to Lujan (1997), the Air Force was added to the original language in 1956. Although the Navy and Marine Corps are not included in the act, they were made subject to it by DoD Regulation (32 C.F.R. Section 213.2, 1992). There is a good overview here by the Rand corporation: http://www.rand.org/pubs/monograph_reports/MR1251/MR1251.AppD.pdf It is very disturbing to see over the last few years how the current administration has eroded civil liberties and positioned itself to maintain power and authority over its own people--evidently now through force of arms. This amendment to the Defense Authorization Act should be stricken, and let's debate this in the light of day as its own resolution.

From the page: The 1878 Act reads, "Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both."

WTF! 1878? Air Force? I had to stop reading this article at this point as it obviously wasn't proofread, or the author is just making shit up.
Probably both.

I thought public opinion and civil disobedience was part of the Boston Tea party and Dr. Kings mark towards positive development in our country.

And I suppose that protests are considered "public disorder" these days? From the page: "The John Warner Defense Authorization Act of 2007, which was quietly signed by Bush on October 17, 2006, the very same day that he signed the Military Commissions Act, allows the president to station military troops anywhere in the United States and take control of state-based National Guard units without the consent of the governor or local authorities, in order to "suppress public disorder."
