"The Lily Ledbetter Fair Pay Act was named after Lily Ledbetter who after 19 years Goodyear Tire Inc. discovered that her supervisors deliberately paid her male co-workers more than she." A jury awarded her damages but the appellate court overturned that decision on a technicality. And the Supreme Court, with its conservative majority, said Ledbetter needed to show the discrimination within 6 months after her first paycheck. But how could she? She didn't find out until much later that her male coworkers received higher salaries. Fast forward to Congress and the Fair Pay Act. Last week Senate Republicans filibustered the bill, basically saying that women should not earn equal pay for equal work. John McCain opposed the bill, OPPOSED EQUAL PAY FOR EQUAL WORK, although he did not show up for the vote and now -- surprise surprise -- his vote is not on record. Barack and Hill voted for the measure.

A jury awarded compensation for back pay plus punitive damages. Republican appointees in appellate courts, however, overturned the jury's decision and used a technicality to throw out the award. The U.S. Supreme Court refused to uphold the jury decision even though it agreed the company's behavior was illegal. The conservative majority cited a rule that required Ledbetter to sue the company within six months of her first unfair pay check. Of course, Ledbetter did not find out about the inequity until years after her first paycheck. The Fair Pay Act changes the rule to give workers who face discrimination, including by gender, race, disability, religion or age, the power to sue six months after their last unfair paycheck. The sponsor of the bill, Sen. Ted Kennedy (D-MA) said, "Workers shouldn't have to be mind-readers to protect themselves from discrimination. Those who suffer from pay discrimination shouldn't run out of time to file a claim for back pay simply because the employer initially managed to hide its illegal behavior." Supporters of the bill argue that without revising current law, companies will have no incentive to ensure fair pay for all of their employees. " How the fuck can anyone with a mind think that it's all right to stick to the older version of this (where you have 6 months from the FIRST paycheck to sue) when the discovery is unlikely to be made when you're in the first blush of your new raise, excited and enjoying that extra $0.30 an hour... I don't know how those filibustering this new bill, the Republicans who overturned the decision of the court to make amends in at least the one case they were brought, or the asshats on the Supreme Court (read as Dubya's rubber-stampers) can sleep at night without crying in shame for the abhorrent miscarriage of their highest duty. I wish that there were a god (and heaven and hell) so that these cocksuckers would get to roast for eternity in fires that were fuelled by their own complete disregard for others, but alas there isn't, so we really have a mandate to strive to correct these wrongs here on earth. Maybe we could start a chant outside the house to break the filibuster...? Maybe we should just reset the whole government and run these guys out of town tarred and feathered and on a rail? That's where I'd vote, but they've got the guns and the army, so I'm staying here in NY. If there's any running out of town going on, though, you've got my admiration and praise!
