- As long as they replace that punishment with something that makes a clear statement, why not? Perhaps removing the offending parts, implanting two a bit higher up, and sticking the perpetrator in a nice little dress into a jail where he can be amongst his own kind would make a clearer statement than any death penalty could - but, wait, that would probably be cruel and unusual...unlike the acts the rapist conducted on a child, right? Gimme a break...
I'm teaching my girls some self-defense against idiots. A society where it's members prey upon their own is a sick society, IMO

"The death penalty is not a proportional punishment for the rape of a child," wrote Justice Anthony Kennedy in his majority opinion.
The justices voted 5-4 in favour of striking down the law. "
